The state Supreme Court is expected to weigh in on a case that could dramatically limit the rights of any Pennsylvanian accused of a crime by allowing prosecutors to routinely use hearsay as evidence at preliminary hearings. At the heart of the case is a little known criminal rule that was quietly enacted in 2011.
There was no opportunity for the public, legal scholars or attorneys to review it or comment on it.
The outcome could have an enormous impact on how justice is carried out across the state; already the rule has been cited in such high-profile cases as Bill Cosby’s.
